MTI Continues Patent Lawsuit Against Atwood Mobile and Moves Toward Trial
(Volo, IL – May 1, 2012) Marine Technologies, Inc (MTI Industries), an Illinois manufacturer of LP Gas detectors and Carbon Monoxide alarms used in the RV industry has sued Atwood Mobile Products LLC, accusing Atwood of infringing MTI’s U.S. Patent No. 7,248,156 with Atwood’s imported “LP & CO Gas Detector”.
Following the filing of the lawsuit, Atwood Mobile Products, LLC requested the U.S. Patent and Trademark Office (USPTO) for a reexamination of the patent and asked for a finding that the patented idea was un-patentable based on claimed prior art both considered and not considered previously by the USPTO.
Historically, 92% of the time a request for reexamination is granted and a process is begun to determine if the patent should have issued. However, the U.S. Patent Office recently issued a detailed 7 page Order denying Atwood’s request because it “…fails to raise a substantial new question of patentability”. Atwood did not appeal.
“We are encouraged by the ruling by the Patent Office and intend to continue to vigorously protect our rights as granted under Federal Law” stated Jeff Wisniewski, president of MTI Industries, Inc.
The lawsuit is captioned Marine Technologies, Inc. v. Atwood Mobile Products LLC, Case No.11-cv-08446.
Federal Law 35 U.S.C. 271 Infringement of patent states -
